STORE TERMS AND CONDITIONS:
The Store – the entrepreneur specified in item 2 of the Terms and Conditions, selling products through an online store www.etoile.com.pl
The Customer – a natural person, a legal person or an organizational unit without legal personality, making purchases via the online store www.etoile.com.pl
The Consumer – a natural person making purchases via the online store www.etoile.com.pl, not associated with their professional or business activities;

The Store conducts sales of goods and services over the Internet. Information about goods and services shall be published by the Store on the website www.etoile.com.pl. The price shown next to the product shall be the gross price – to be paid by the Customer, including all taxes and other public levies, and fees.
Information about goods shall constitute an invitation for entering into a contract as defined in Article 71 of the Civil Code. The Customer, by submitting an order with the Store, offers to enter into a contract of sale with the Store for the ordered goods or services. Every payment made by the Customer – except for payments at order receipt – shall, until sending by the Store of a confirmation of order acceptance, constitute a prepayment for order execution.
Purchase of goods via the HYPERLINK "http://www.etoile.com.pl" www.etoile.com.pl website, in order to be effective, shall require a proper order placement, by means of interactive order forms and selection boxes appearing on the website in accordance with the current step during purchase, and choosing the form of payment. Prior to placing the order, the Customer shall be informed about the total costs of its execution, which include the price of selected goods and costs of delivery, the amount of which shall depend on the method of delivery chosen by the Customer.
Packages within Poland shall be delivered via the courier firm "POCZTEX" by Poczta Polska (time ca. 1 – 2 working days). International consignments shall be delivered via Poczta Polska as priority mail, and the time of delivery shall depend on the delivery area, which can be reviewed on the Poczta Polska website. This time usually varies between 3 days to a week. Goods shall be sent within 1 – 3 working days from the moment of order placement and payment receipt. In case of ordering goods as PREORDER, the time of shipment shall be 7 – 14 working days.
Should the order not be possible to fulfil, the Store shall notify the Customer no later than 14 days from the date of order receipt. Notification will be sent to the e-mail address designated by the Customer in the order form. Should the Customer place the payment for an order referred to above, the Store shall return said payment.
Should the payment for goods ordered not be made within 14 days from the date of order placement, the Store shall cancel the order and inform the Customer of that fact, by sending a relevant e-mail to the address specified by the Customer.
Promotional sales and bargain sales shall include a limited amount of goods. Order execution shall be made in accordance with the sequence of order placement until the point of inventory depletion of goods covered by this form of sales in the Store warehouses, or at its suppliers.
The Store shall be obliged to issue a defect-free product. Should a defect be found, the Customer shall in particular have the right to submit a complaint within 2 years after the date of delivery, and 1 year from the date of observing the defect. On the terms set forth in the Civil Code, as well as in relevant Acts, the Customer may request the goods to be repaired, exchanged with defect-free goods, a price reduction, or may withdraw from the contract of sale. In such a case, the Customer should send the product back to the Store address: Etoile Anastazja Jaworska, ul. Bobrowiecka 3A/28, 00-728 Warsaw. The product should be accompanied by the proof of purchase with a description of the complaint.
The Store shall immediately, however no later than 14 days from the date of receipt of delivery with the returned product, answer the complaint submitted, and shall inform the Customer about further proceedings.
According to the Act of 30 May 2014 on consumer rights, the Customer being a Consumer, may withdraw by means of a written notice, from the contract, without specifying the reasons, within 14 days from the date of receipt of the delivery. The Customer should submit the notice of withdrawal from the contract, by sending it to the address of the Store: Etoile Anastazja Jaworska, ul. Bobrowiecka 3A/28, 00-728 Warsaw, and return the product to the Store. A template of the Statement of withdrawal from the contract shall constitute an Appendix hereto.
The returned products have to be complete. The products should be returned in an unchanged condition, unless such a change proved necessary within the boundaries of ordinary use i.e. the Consumer should handle the products, bearing in mind the need for their possible return in the future. The Consumer shall bear responsibility for the reduction of value of items, resulting from their use in a manner other than necessary for identifying the nature, features and functionality thereof.
The Store shall reimburse the Customer for the returned products within 14 days, to the bank account indicated by them in the statement of withdrawal from the contract. The Store shall not be responsible for non-reimbursement, or its delay, should it occur due to inaccurate personal data submitted by the Consumer (first and last name, address) or an incorrect account number.
The Consumer shall bear any and all direct costs of returning the product to the Store.
By placing an order in the Store, the Customer expresses their consent to placing their personal data in the database of Etoile Anastazja Jaworska and processing thereof for the purposes of executing the contract. Submitting personal data by the Customer shall be voluntary, however, the lack of consent to processing thereof makes it impossible to execute the order by the Store. The Customer shall bear responsibility for submitting untrue personal data. Personal data is protected in accordance with the Act of 29.08.1997 on personal data protection (i.e. Journal of Laws no. 101 of 2002, item 926, as amended) in a manner preventing access by third parties. Customers shall have the right to access their personal data, amend them and request their removal.
The contract of sale shall be entered into by and between the Customer and Etoile Anastazja Jaworska.
Products presented on the web site of the Store, do not constitute an offer, as defined by the Civil Code.
The Store shall not be responsible for administrators blocking mailing servers, sending messages to the e-mail address indicated by the Customer, as well as removal and blocking of e-mail messages by the software installed on the computer used by the Customer.
The Store shall not be responsible for errors in order execution or that in other Customer dispositions, arising due to incorrect data submitted by the Customer.
Possible disputes between the Customer being a Consumer, and the Store, shall be subject to settlement by the relevant court in accordance with the Code of Civil Procedure of 17 November 1964 (Journal of Laws No. 43, item 296, as amended).
In cases not regulated herein, the Polish legal regulations shall apply, in particular those within the Civil Code, the Act on Consumer Rights, and the Act on Services Rendered Electronically.
These Terms and Conditions shall be valid from 25 December 2014 until revoked.
The Store reserves the right to amend these Terms and Conditions. Any changes to the Terms and Conditions shall enter into force on the date indicated by the Store, no earlier than 7 days from the date of their publishing at the www.etoile.com.pl website.
